RI - Hey, Isn’t That My Spot?
It’s always an adventure when an association, a property manager, or a unit owner comes in and asks us to fix a parking space problem within the condominium. Specifically, while in the process of exchanging parking spaces with one another, the titles to the units sometimes gets tangled up and needs to be untangled.
The last case I worked on concerned a series of parking space swaps between 14 unit owners. The faulty exchanges were on record and mistakes were carried forward or at least not caught until counsel to one lender rejected the title to the entire set of units. After months of investigation involving the titles to all of the units, I came up with a plan involving taking and recording corrective deeds from all of the unit owners involved, as well as the preparation and recording of an amended site plan, a difficult and expensive task that could have been avoided if the appropriate approvals and documents were drawn up, and recorded in the first place.
