An Alternative Dispute Resolution Service*

Condominium Dispute Resolution (CDR) is an alternative dispute resolution service established under the New England Chapter of the Community Associations Institute to assist in the resolution of conflicts arising in community associations.  Alternative dispute resolution (ADR) may take the form of mediation or arbitration.  Mediation is a process whereby a Neutral attempts to reason with the parties to facilitate a voluntary settlement by focusing attention upon the parties needs and interests rather than upon their rights and positions.  Arbitration is a process whereby a Neutral renders a decision after hearing an abbreviated version of the evidence and depending on the agreement of the parties, may or may not be binding.

 

*CDR and the CAI New England Chapter reserve the right to decline any specific mediation and/or arbitration request for any reason.

Administration & Fees

Administrative Fee:

A $500 ($600 for non-CAI members) non-refundable administrative fee is due and payable in advance at the time a dispute is submitted split equally* by the parties.  If a Respondent declines to participate, the matter shall be terminated and the Initiator's deposit less a $50 administrative fee will be refunded to the initiator.

 

*$250 ($300 for non-CAI members) shall be submitted by the Initiator with the Request and $250 ($300 for non-CAI members) shall be submitted by the Respondent with the Response.  If either party is a CAI member, the CAI rate shall apply.

 

Neutral's Fee:

The Neutral shall be compensated by the parties at a rate of $200 ($300 for non-CAI members) per hour for the first three (3) hours and at $300 ($400 for non-CAI members) thereafter.  There will be a two hour minimum charge.  A $600 ($900 for non-CAI members) deposit shall be submitted upon selection of the Neutral.  

 

Appointment of the Neutral:

Upon recept of both parties' completed forms and payments, the parties will choose a Neutral from a list of Neutrals provided.  If the parties cannot agree on a Neutral, one will be appointed by the Administrator.

 

Dates & Times of Hearings:

Hearings will take place at a mutually agreed location and date.  If the parties cannot reasonably agree to a mutually convenient date, time or place, the Neutral shall establish a binding date, time or place.
